IRS Notice 2012-40 now states that “…the $2,500 limit does not apply for plan years that begin before 2013.”

It's simple. You signed up for a discounted package which required a contract to keep that package for a certain amount of time. You got a "credit" for the amount you "saved" for signing up for the discounted package for that predetermined time frame. If you decide to cancel your discounted package before the end of your contract you will be charged the full amount that you "saved" since you did not follow through with the terms of your agreement. Other words you did not read the fine print. You agreed to use their service for a predetermined time for a discounted rate.

I have no dog in this fight since I don't use the HCFSA. But a simple google search for "what is the limit on HCFSA" indicates that the limit for 2013 is $2500 per individual. I think in his mind he was thinking it would be a good moral booster not to mention the money it brings in. Of course the broader issue was how were people even going to get there let alone run. It would have been wiser to postpone it.
