  8. Yes, if that was the case. If the court found the action of the accused was invited and or solicited by the victim, therefore the provisions of the rape statute would not apply. SO. Let me rephrase my prior statement in another way that is a little more spin proof. . To me this is the equivalent of a judge dismissing a rape case where compelling evidence and testimony proving guilt beyond a reasonable doubt was presented, because the victim had a reputation of being promiscuous.   9. I’m with ya as far as the banks and mortgage companies go I do not care for them at all. But when judges start thumbing their nose at the very laws that are in place that they are sworn to uphold and start issuing verdicts based on “feeling” and not in line with the law we have a problem. To me this is the equivalent of a judge dismissing a rape case because the victim was a prostitute.
  10. I must admit I do not have all of the facts of the case. But from what I can gather the judge did not like the outcome of over three years of the mortgage company trying to work with these people and when they started to exercise their right to proceed with foreclosure the judge called them aggressive. The judge is to decide ONLY one issue in a civil case like this. IS THE DEBT OWED, IS IT A LEGAL DEBT AND ARE THE DEBTORS IN DEFAULT.   14. These will be the first holidays without my dad. It’s strange being here in the house on thanksgiving eve, I feel like I need to go check on him or that I will hear him call out to me or mom to get something for him. I will get through the holidays ok, but mom is going to have a VERY hard time with it. Fifty years, fifty thanks giving, fifty Christmas holidays together, and then the first of these without the person you have spent the prior fifty with, I can’t imagine how mom feels, I just hope there is something I can do to help ease her pain through these holidays.

  18. I can tell you exactly what the problem is. Most of today’s servers are of the Gen Y and later population. Many of these folks have an entitlement/slacker mentality. They believe you “owe” them a tip regardless of the service they provide and their demeanor and attitude reflect this; this is also reflected in the decline in amount of gratuity one is inclined to leave a server.
