In the past when I've rented houses in neighborhoods with HOA fees, the owners would always incorporate the fee as part of the rent. You may want to double check that you AREN'T paying it in some way and that it says S/HE is responsible for it. You may BE paying it and he may not. If your lease says s/he's responsible for it, and s/he isn't paying it, then I believe that would be a violation of your lease. Good luck!
