I find some of these to be very naïve questions this day and age, I don't mean in it a insulting way in the least. The arresting agency goes to the Magistrate Judge to take out a warrant (in this case Felony Murder and Cruelty To Children). The arresting agency presents the probable cause to the Magistrate Judge and the Magistrate Judge approves the warrant if he agrees there is probable cause for the charges.
