  1. NO! We need to come up with something that will attract more business to Paulding - not more people to move out here looking for cheap housing. I like the fact that Paulding is more rural than Cobb or Gwinnett Counties.
  2. This is one of my serious fears. I am terrified of snakes - I even hate the fake rubber ones. I couldn't even watch the whole video of this. If I run over a snake in the road, I always look in my rearview mirror to make sure that the snake is still in the road and didn't leap up in the underside of my car (to wait until I stop so it can attack me). Okay, I know that's not rational, but I fully admit that I have an irrational fear of snakes.   3. There is one on Spring Street, just south of 14th, in Atlanta. I don't know the name, but I pass by it occasionally on our way home.

  5. Talk to your local bank and ask them about a rollover account. I would let the Wal-Mart stock sit for awhile - you can purchase additional non-employee shares of the company later through a brokerage firm. I also recommend Edward Jones - I don't know the name of a local guy, but my hubby has used a guy in South Carolina for years and loves them.

  7. Thanks - that makes sense. I was looking to see if I could access the docket report for Paulding Superior on Westlaw and that case popped up, but only because the insurer filed a complaint in federal court. Paulding really needs to come out of the dark ages and get their docketing online.
  8. Surepip: I know I'm a pain, but I'm really just trying to get a clear understanding of all of this. In doing some research, I noticed that you filed a lawsuit against Contour in 2006 (case no. 06-cv-2242). You dismissed that case in 2008. Was a settlement reached or was it dismissed for some other reason? Thanks for your continued patience with me.
  9. No, if I think I'm right and I have a case, then yes, I would fight it. BUT, I would ask myself if I'm pursuing the right defendant. Just based on your side of the story, I'm thinking that Contour Development is who you should be pursuing - they did the actual damage to you and your property. Yes, the county has deeper pockets and has some guilt in this, but it wasn't county employees who destroyed or prevented access to your property.
  10. Here's a simple answer: I don't know why the county has had to spend that much money (and no one on this board can answer that). Perhaps you are right and they could be covering something up and trying to break you OR it could be that they have a very viable defense and your settlement demands are too high (and continue to climb). Without seeing all of the facts, no one can answer that question.

See, I still don't know what to think - I haven't seen all of the pleadings so I don't know what the county's response to the lawsuit has been or how many different motions have been filed and by whom. Surepip has a great story, but remember, there are two sides to this story - actually 3, there is a developer involved in this case too (even though Surepip seems to have stopped looking to them for any liability). I wish Surepip well and I hope this case comes to an amicable solution, but until then, I do expect the county to defend itself if it believes it is being unjustly targeted.
  12. But why are you asking for 1/2 of what they have paid to the county's attorneys? Do you feel like you are entitled to that as a matter of principle or do your actual damages equal that amount? It still seems to me that your best best to recover actual damages is going to be with Contour's insurance company. P.S. You need to make it a point to know what Womble and Contour's actual status is, since they did the physical damage to your property, keeping tabs on them would be crucial.
  13. Surepip - I'm not trying to frustrate you or imply that you're wrong, I've just spent too many years on the defense side of lawsuits so I tend to look at things from that perspective first. So, that being said, I really do appreciate your taking the time to explain things to me. Is Contour and/or Mickey Womble bankrupt? I'm wondering this because I keep seeing all of the damage that they did and wondering why they aren't your first target.   14. Sorry, I'm lost again - why do you want 1/2 of the attorney's fees paid to H&K to settle this case against the county? I see getting the 10' back and some of your attorney's fees since the county is a party to the suit, but, from what I'm reading, most of the liability appears to lie with Contour Development, not the county, since Contour did the actual damage to your property. Am I missing something?

  16. Actually, you made the comment about the persuaveness of the argument posed by Surepip's attorney being lost with the appeal. The Georgia Court of Appeals will allow oral argument in cases - surely he can be persuasive a second time.... :-) Appeals are standard when an amount in controversy is this high. Chances are settlement discussions will ensue again and as long as both parties are reasonable, this case could settle. I would also think this would also be a good time for Surepip's attorney to recommend mediation of the case.

  19. Surepip - I sympathize with you. What I'm trying to understand is WHY the county is fighting. What is their position on the lawsuit? If your case is so open and shut, have you filed a Motion to Dismiss? Has the court ruled on it? Has has either party filed a motion for summary judgment? Has the court ruled on that? What case law is the county relying on? What are their defenses to the lawsuit? These are the details that interest me. Five years is a long time, but maybe we could all understand some of the delays if we knew all of the facts. Unfortunately, without access to all of the pleadings, we don't have that information. Again, I'm not saying that Surepip is wrong or that the lawsuit is frivilous, but if we're being asked to push the county to settle, I just want to know all of the facts.

  22. I haven't seen the pleadings in this case so I don't know that all of the delays have been the county's fault. I've worked for a mega-lawfirm for 20+ plus years and I've seen that it generally takes at least two years to get a regular case to trial in the state courts. If there are multiple parties in the caswe, it takes longer. If there are multiple motions filed in a case, it takes longer. If the judge has a big caseload, it takes longer. If a case is reassigned, it takes longer. There are a multitude of reasons why a case doesn't get to trial within a reasonable time period. But

Unfortunately, unless someone posts them here, the only other way to see them is to go to the courthouse and look at the file or pay for copies and I don't have the time to do that. I'm not saying that I agree with the county, I merely want to hear their side of the story.
