Her actions there could have been construed as political speech and, disrespectful as it was and as stupid as the thoughtless action was, political speech is protected speech.   13. That's not what I said. I didn't say what she did was silly. You are putting those words in my post. In discussing the bigger question about non-employment actions and termination beyond this specific event, THAT was how I used the term "silly."

  15. I don't think you're hearing what I am saying. Remember this next time you do something really silly and wonder should your employer will terminate you for it. It's a thought. Should she be fired? Probably, since it is certainly reflecting on the business. Bigger picture and bigger question for other situations would leave a lot of room for discussion about a termination policy over non-job related actions.
