Silver Comet Killer Wants Sentence Thrown Out
eym_sirius replied to onekidmom's topic in RECENT TOPICS
It's automatic because it could be argued that if the appeal weren't automatic that there would be grounds for a last minute stay of execution because the specifics had never been reviewed. The specific grounds would be a lack of capable representation. I don't begrudge the individual an automatic appeal. Once that the verdict has been reviewed, there's no need for further discussion if there are no legal issues. Let's go with it. -
Great! So the next revelation will be from the dad-sired siblings - That's where the dozen will show up. That's about a month of shows right there!
-
I guess that's where I am about this - I don't buy the deep dark secret thing. It WASN'T a shock, not even a mild surprise. I don't believe anything that comes from commercial t.v., including Oprah's account. It's like reality programming, which mimics certain real situations without being real.. But without the setup, there's no show. If Oprah had said that she's known about her various half-siblings for many years and here's one of them, then everybody just goes -- "okay.. so what?" But a SURPRISE SIBLING???? That would be something that -- she could base a whole show on!
-
The possibility exists that Oprah paid her hush money, which is why she may have gone straight to Oprah. One never knows the whole story and I'm too jaded to take these revelations at face value. America will be shocked? See why I'm jaded?
-
Oprah's bio-dad went about spreading his seed and not marrying the women he impregnated and Oprah is shocked that she has a half-sibling? She could have over a dozen half-siblings! Maybe many more!

Silver Comet Killer Wants Sentence Thrown Out

While I appreciate the degree to which we afford convicted criminals the opportunity to appeal their cases, it's my opinion that there should be a fast-track category. It would be reserved for certain cases, the specifics of which would be determined by the law, but it would be generally those who were convicted of first degree murder with egregious circumstances (to be specified) and absolutely no doubt of guilt and no mitigating circumstances (no insanity). Here's a hypothetical and my idea of a resolution: A person did it, there's no question that he did it. He's not crazy and there ju -

Does A Lawyer Have To Be Paid For Advice

I think that "The Postman" was -- a Postman. Retired now, I think. Sure, he makes a lot of spelling mistakes. But I'm a believer in multiple intelligences, meaning that a person can be deficient in one area and be perfectly brilliant in other areas. That's why I don't pay too much attention to principle vs. principal (the mnemonic device being "the princiPAL is your pal") and other such spelling errors. FYI, PCOM rules don't allow people to criticize spelling because it invariably becomes a spelling contest as opposed to the open exchange of ideas and the freedom of expression. In other wo -
Questions? Comment? Emotional Outburst or Rude Gestures?

What people dislike the most is a face-to-face confrontation. If today's mail has run and the check isn't in today's mail, she should call them to tell them that her parents will be by there to pick up a check for her on Monday. If a check had been sent, it's lost in the mail or will be sent back if it arrives. A month later, it's time for her to get paid. She shouldn't accept the option of waiting until the check arrives and she should tell the director that today. She should use the term unacceptable and should recap the conversation in an email to the director. No threats, just a clea -
Does A Lawyer Have To Be Paid For Advice
eym_sirius replied to Eddie Bennett's topic in RECENT TOPICS
An attorney is a professional. so just like any other professional, when you avail yourself of their services, you should expect to pay the professional fee. Yes, a lawyer typically has to see a portion of his fees so that he/she is not out of pocket for the expense of filing, etc. Principle? A principle is something that is personal. The principle belongs to you, not to the attorney. An attorney will represent your position and counsel you -- for his professional fee, In that way, you can advance your "principle" if it has merit. What is "ethical" for an attorney is this - -

See if they will allow you to pick up the check from them. They'll need to stop payment on the other one. -
Labeling Is An Attempt To Cut A Person Down.

Okay, I kind of follow you now. If you're talking about your civil right against defamation on a message board, in order to get a judgment in your favor, you'll have to be able to show monetary damage. You -- not "The Postman". It's the problem with operating under an alias. I imagine that this is why Pubby has a rule against disparaging comments about Commerce Members. They necessarily post under the real name, not an alias, of their business and a business could show monetary damages coincidental with disparaging comments, rumors, innuendo, etc. You're right. You shouldn't -
Labeling Is An Attempt To Cut A Person Down.

TP, you're not even expressing yourself in complete sentences! What does this mean? ["If am talking about he real world, in my opinion."] And what does this mean: The real world will be decided based on a Jury decision, in court, but my opinion regarding the real world may be somewhat different than yours. I'll be happy to carry on a conversation about this, but I need just a little more than talking in code. You apparently want to talk about this, so let's talk. It's not "debate" because I can't make enough sense of what you're saying to form an opinion about it. -
About the air horns - I disagree. I think that airhorns would be as obnoxious to the good neighbors as the other dogs being in your yard would be to you. Pepper spray the dog when it comes onto your property. A homeowner/landowner has a right to protect himself, certainly. The dog will learn its boundaries from a pepper-spray fence if the owner won't build an actual one. Take pictures, too, as proof that the dog was not on a leash and was on your property. And pepper spray won't aggravate the good neighbors!

There's a requirement for a judgment in civil cases, TP. Are you talking about PCOM or are you talking about the real world? 51 = Tort 9 = REAL ESTATE ??? What does real estate have to do with libel? I think that your idea about this tort is half-baked. -
He Who Seeks For Applause Only From Without
eym_sirius replied to Eddie Bennett's topic in RECENT TOPICS
There you go again, TP. Don't you get tired of using the same trite phrases? I know - you're not replying for the applause of anyone else, but for self-applause. This one is worthy of only half an applause, so you can put one hand down and applaud yourself with the other. Truth is, there are "ifs" with almost everything. There are few absolutes. Yes, everyone needs to be comfortable with his own accomplishments, performances, the way that he handles responsibilities and duties -- all of that. But to deny the worth of validation from others? As long as the validation is honest, as oppo -
For the OP - get some pepper spray. If the dog attacks you, postures against you in your own yard, pepper spray him. Save some for your neighbor if he doesn't like it and starts in on you on your property.

Hello! Elwood!! This is PCOM. Of course when I read the 90% figure it was, on it's face, a ridiculous statement. If he/she said, "Of course it was hyperbole" that'd be one thing. Any conclusion that he/she (not to be confused with A HE-SHE) comes to is undermined by a faulty, ridiculous premise. Asking people to make a logical statement after they have defended their own ridiculous statistic - it's just not going to happen. In the real world, yes, a person should be able to defend what seems to be arbitrary percentage statistics presented as facts. But, like I said, this is PCO

Is It Appropriate To Wear Any Type Of Clothing To Church?
eym_sirius replied to ButterflyLion's topic in RECENT TOPICS
The hell? Judge much? Take the word, "god" out of the equation and all you have is a bunch of jerks trying to feel better about themselves by passing judgment. Don't be surprised by the church becoming increasingly irrelevant. You can always refer back to your post if you want to try to figure out "why". -
I'll just use my imagination for your "special smiley" I was using red , but I just now changed to dark gray. I think that I can see everything better this way.

Is It Appropriate To Wear Any Type Of Clothing To Church?

I agree with you! When you all walk into the church naked --- Close your eyes! Then you won't realize that you're naked!!! Either that, or learn to sew!
