Someone quit their job in order to take a higher paying job. Didn't make that much in the new "higher paying job" debatably because of the tourism slowdown, but since that job was in an area impacted by the Gulf Oil spill she got a check to cover lost wages. GOOD! I'm glad someone other than the government got some of BPs money. I figured when all was said and done, the government would pocket most of the money that BP had has to spend on their little error. 1099 recipients are not "employees". They are subcontractors and as such they are themselves independent business owners, responsible for their own taxes. Believe me, I understand that situation. I understand that if a licensed contractor hired an unlicensed sub that they (the licensed one) could lose the license. I understand all that, and more. I am really at a loss about the "1099" part. Why in the world would the state even mention that in the OCGA if the state does not receive that form from the contractor? In addition, if it were just based on the issuing a 1099, and not the actua

the issuing of a 1099 is a federal issue INCOME reporting mechanism. It has nothing to do with it being illegal to assist an unlicensed contractor. Two different and distinct acts. I have to question why the state even puts the statement about issuing a 1099 in there. 1099s don't get sent to the state anyway. Interesting.

In order to issue a 1099 to a subcontractor/contractor it is not necessary to validate their license status. It is customary not to send them to incorporated businesses but beyond that, there is no legal reason to validate anyone's license status.

I've seen the following: presumably illegals having more than one Social Security card presumably illegals having invalid SS#s SS#s and names the # was issued to being different. SS#s being used by someone who is very much alive but the # was issued to someone who is no longer alive. Two people alternating the same number. Unless your full time job is verifying this information, you might be fooled on some of these things, too, because they look very real. The SSA has a great e-verify service but I'd say MAYBE a handful of employers in this area use it.

I'm guessing not drugs. They wouldn't need to stop every truck at the weigh station to find drugs. Just pull over any truck speeding around Post Road and they could find drugs.

YIKES! I can imagine what a 6 million dollar policy costs you. Even if it isn't quite 3 x what we pay for our 2 million policy, that's still a chunk of money. Bless you for providing health insurance. I'm hoping and praying that I can get a job that has that benefit. It will be two years before hubby is eligible for Medicare, and another 9+ years for me. I just don't want to drive a bus in order to get health insurance (and no offense to my friends who do drive buses).

Don't know what amount of general liability you carry, but I don't think any of it is cheap. We had to carry 2 million in liability just to set foot on the customer's property. It wasn't cheap. Plus we have done everything by the books--business license even though we are home based, incorporation, pay all the payroll taxes, file all reports on time, report new hires as required. Amazing what some people pass off as "being in business". Sure not operating the way we do, legally.

Keep trying to get that info. Sometimes the SOS website is pretty picky about what you put in. Even a capital letter where there isn't one can throw it off. Also, try putting in the person's name as registered agent. Knowing you, you tried that already. -
even "light maintenance" can be screwed up. It may be spring before he gets the account back, but he more than likely will get it. Best of luck to you. And congrats on the baby!

I would file in small claims court, wait for a judgment. Even if it means having to wait for the money, at least you would legally be in line to get something should they file bankruptcy, or take out a loan. If it is a corporation, the shareholders are more than likely not liable. -
I wouldn't report them. I also wouldn't celebrate too terribly much when the company that got the contract either goes under or does such a lousy job that the company your husband was doing the work for calls him to get him to start back doing it. I've seen it happen before--landscape company loses account to someone cheaper because the company doing it cheaper is doing it with illegal workers and that company does such a lousy job that the first landscape company gets the account back. Let us know if your husband gets the account back. My guess is he will, even though it might take a

It really depends. In the past we had COBRA and when it ended we got private insurance which was HIGHER than COBRA. Not by much--maybe $50-$75 a month but it was higher. I just dread seeing what it will be next. Our COBRA, which is under the subsidy, will be ending in the next month or so. And most of those plans are higher than we were paying on COBRA this time last year. But we pretty much HAVE to have health insurance because we would pay almost as much for just one office visit to the pain specialist and two to four prescriptions as the insurance costs. The good news is that you have 60 days from the date of the letter to sign up for it and it continues as though there was no break in coverage. I remember from all the times we have been on COBRA, including now. -

Here it is: If you lose your job after June 1, you'll see more than just your paycheck disappear. You also won't get the 65% federal subsidy to cover your COBRA health insurance premium. -

Hubby and I went to North Georgia the day before Labor Day and there must have been 200 bikes out there. We were a little surprised there were that many, but it was a beautiful day. We were in the little red convertible and not the one I drive. Sure hated to sell my car because I liked it, but why in the world do two people need three cars? I Googled that and it depends on what the law is in Georgia. I would suggest to the OP that the cousin contact the former employer and TELL him that he (the cousin's husband or whoever) is contacting the DOL. My guess is if the employer hasn't paid the employees, he hasn't paid the payroll taxes EITHER. He will have more *&%$ than he wants to deal with and very well may make the checks good just to keep the employees from calling the DOL.
