He has the right to not say the pledge and no one has the right to tell him to leave while exercising his right. The judge has the right to order decorum in the court room but that judge cannot infringe on the Constitutional rights of the people in the court room while doing so.

That would be wrong too. Telling the lawyer to leave the room would squelch any public free speech of defiance. Free speech means the liberty to sit there if he wants to, or leave if he wants to.

A lawyer in Mississippi was thrown in jail on contempt of court charges for refusing to recite the Pledge of Allegiance as ordered by a judge. The lawyer insists his right is to not say the pledge if he doesn't want to and the judge said the lawyer had to do it anyway. Here's the Fox News story.
