  8. It all depends on the merits of their case Whitey. Let me ask you something. Follow me for a moment if you will. Let's say I filed a lawsuit against the county and in that suit I was asking for $5 million plus attorney fees. Now let's say this suit is going to cost the county $1 million to defend. Do you think the county should just say, "to heck with it, lets offer him $500,000 plus attorney fees and be done with it," to save money?

  10. Aren't you making the assumption it's the fault of the BoC this hasn't gone to trial yet? As Lisa and I both pointed out, the judge can set a trial date and both sides would have to show up.
  11. That's not unusual at all Blue. My question is this; why doesn't the judge assigned to this case just say "enough is enough" and order it to trial? I wouldn't put the entire blame of the delay on the BoC.

  15. Actually, it's not unusual at all. It happens all the time in this country. Sometimes it's because the plaintiff is asking for an exorbitant amount of money. I had a friend of mine sue the Michigan State Police and the State of Michigan for reverse discrimination. It took five years before the judge finally ordered the case to trial. The jury awarded him $800K as well as attorney fees in 2001. He still hasn't received his money because the state keeps tying it up in the State Court of Appeals. Nope, it's not uncommon at all.

Who is defending the actions of the board for this lawsuit being dragged out?   18. I totally understand that. The only reason the county should settle is if they felt they would lose the case in court. Like you said, settling a case they could have won, could set a very costly precedent for zoning issues. As I have said several times now, we have not heard both sides of the story and we don't know the whole truth in this case. For all we know, it's not just the lawyers for the county who have prevented this case from going to court. We only know what surepip wants us to know.

You want to mock me because I haven't followed surepip's posts on this suit closely since he filed it? If you know the answer to my question, then why not just give the answer instead of making a sarcastic comment?
  20. How many times has a judge ruled in his favor? I have seen civil suits before where the judge had ordered a trial when they tired of all the motions to delay and a settlement couldn't be reached. Why hasn't a judge just set a trial date on this?

Let's say the county rezoned some land for a builder to construct a PRD. Let's say it encroached on another person's land and the value of the land encroached upon was worth only $10,000. The owner files suit against the county and is seeking a monetary value of $5 million plus legal fees. Now let's say the county made a settlement offer of $10,000 plus legal fees and the plaintiff refused and made a counteroffer of $2 million dollars. Later, t
  23. It depends. I have no idea what monetary amount he is seeking nor do I know what monetary amount he made as a counter offer to any of the county's settlement offers. As I said before, we don't know the whole truth because we haven't heard every detail in this case. How much money is surepip seeking as a monetary award in his suit?   24. There's always two sides of the story and we haven't heard the county's side of it. We most likely won't because it would be foolish for the county to address the issues publicly while the suit is active. How does anyone know for sure that everything surepip tells us why this suit came about is the truth, the whole truth, and nothing but the truth? Like I said, there are two sides to every story.
