  1. See, thats the bottom line, the end. You can't tell me that anyone with a contract would take the breaking of that contract lying down and if they say otherwise, THEY ARE LYING. Should she have had a contract? I don't know, maybe not.......BUT SHE HAD ONE because she was smart enough to insist on one, it was broken and she didn't stand for it, just like nobody else would have. But she doesn't seem to be the only one in Paulding suing people, so why is one lawsuit OK and one not? It's costing the taxpayers of Paulding county just the same.

    And his has cost way much more and those who trashed Jerry in the last election felt getting David in there would move his suit forward. Well it did not and all I am seeing is someone who is bent on destroying someone just because they happened to work for the past admin.

     

    He should be moaning about David, not Beverly.

     

    So, these broken contracts that you speak of, had YOUR name specifically on them just like hers did? Why is it OK for you to sue over a broken contract and some sort of anarchy when someone else sues for the same thing? Thats like the pot calling the kettle black.

    Subby got my lawn tractor starter repaired late Friday and I installed it yesterday and have been cutting almost 3 acres of knee high grass.

     

    Now to reiterate:

     

    I did an open records request for "any available information/paperwork concerning any and all financial and other settlement details in regards to Beverly Cochran and her departure from her employment with Paulding County."

    I was given the 9 page settlement agreement and consent agreement and 2 canceled checks. All 9 pages I received have been posted I believe by Patton. I was unable to get them posted myself.

    I have since sent another request, and have asked why I was not given Beverly's "Employment Contract". I assume I will hear something next week.

    However, that does not change the jist of my topic: That is "Why is Beverly running?"

    From where I sit she has an ax to grind with David Austin and the fact she was indeed removed from a very high paying cushy local job. I know many with graduate degrees and 20+ years of experience who are driving an hour to work for far less than $64,000 per year. And Beverly with a High School Degree is knocking down $64k working locally. Yes, I might try to get revenge on someone who I thought cost me a job like that as well.

    I had a great deal of interfacing with the Chairman's office from 2002 untii 2006 when I entered my suits against the county. I had a great many conversations with Beverly during that time up to when I filed my suits. I found her to be very artful at dodging the issues and changing the subject including when she refused to provide me with a written copy of the zoning stipulations showing my stipulations at the March 22, 2005 BOC meeting, stating instead "I only have enough copies for the applicants so you cannot have one".

    That also happened to be the stipulations which contained errors and mistakes, but we did not receive our written copies until a month afterwards.

    And for what it is worth, or not, my suits are also for broken contracts.

    The contract I had with the county to enforce the laws, rules, and zoning stipulations.

    We were given written stipulations, which the developer ignored, and the BOC, Community Development Office and the PDOT all looked the other way and let the developer do whatever he wanted, including taking part of our property. The first 2-1/2 feet of the front yards across the street is land we paid for 27 years ago and land we ARE STILL PAYING TAXES ON TODAY, including the entire street.

    And since then, the BOC with the same "Three Beverly Vote Members" have made the decision to pay out over $1MILLION Dollar of taxpayer money in legal fees to Holland & Knight Law Firm in Atlanta to litigate us and attempt to prevent us from getting out day in court. Is that the same sort of contract ?

    Your comment on the teacher's not having contract challenges is in error as well. ALL of the teachers have taken furlough days NOT IN THEIR CONTRACTS. Should they file a class action suit ?

    I see Beverly wanting to get on the BOC to keep up and maintain the RBMD voting block which still exists today. Kirby and Powell are both retiring and you can bet your ass the RBMDs are concerned about loosing control of the BOC with only Ragsdale remaining. With Beverly elected they will be a step closer to maintaining a presence.

    If you want to support Beverly; endorse Shearin's regime; and let the RBMDs keep doing their puppeteer show; then by all means go out and vote for Beverly. The RBMDs and builders will be glad you did.

    If you want to break the RBMD control then vote for Todd Pownall.

    It really does boil down to just those choices.

    If I have followed and understand the issue correctly, It is not a matter of smarts, But rather a political connection with some of the good old boy commissioners left over fron the previous adminstration

    I have talked to her and her only reason for running was because people were still calling her needing help and she was no longer able to do so. After many, many request for help and people asking her to run for office, she decided to run.

    You are correct as one of the reasons she is running and getting my vote.

     

    Dang Pubby, right after I give you props, you revert back to the darkside and starting making statements about something unrelated to the topic at hand. I ask again, do you have any proof of your accusations? Or mearly conjecture on your part because of an experience from 34 years ago?

    And I was only 8 years old like it matters to me today; like I had something to say back then.

  5. One more time...Beverly had a CONTRACT...it doesn't matter how she got it, she had a contract signed by David.

     

    When a contract is broken, there is compension due to the affected party. It is plain and simple and such cases go to court all the time when contracts are broken.

     

    I'd like to see some of you naysayers who are moaning and groaning go and create a contract with another party that involves anything and then they break it. What would you do? I know what you would.

    No it is not although she did one time and the one she did vote yes on, it would not have mattered since the rest voted to raise the tax which with her no vote, wouldn't have mattered. She does regret it.

     

    She was the most anti-tax person on the board and when the rest wanted to raise the tax, she was always the loner and they would always put pressure on her but she didn't bend. She has said many times that raising taxes is not always the answer but the rest did not want to hear of it.

     

    You can ask her about all of this now by contacting her or on June 19th at the Republican Meet and Great and White Oak Park.

     

    I asked her about this tax stuff and she was straight forward with me on it.

     

    So overall, no, she is not for increasing taxes regardless of what anyone says.

    But remember there is politics involved in this and there are competing factions in the county.

     

    That there are five votes on the commission and when Chairman Austin came in, three of those five votes wanted to keep Ms. Cochran over the chairman's objection is politics.

     

    That is actually 'pretty strong' in terms of politics. Indeed, in this time of severe government cutbacks, few teachers or state and county employees have the pull to get a letter like the one written for her that would promised them a job through the July 2011.

     

    I think the relevant issue here is that she had the political power to gain leverage enough to get the letter written by someone who really didn't want to write it (Austin.)

     

    But the point as far as the current race is concerned is that she much more than a dutiful assistant to the former chairmen (Shearin and Carruth) but a powerful player with political skills and abilities enough to avoid being pushed into the cold with little to nothing in the way of severence, unlike most in government who lost their jobs and became hapless victims of the economy.

     

    I do understand why David Austin, having already been forced by Ms. Cochran to do something he didn't want to do (sign the letter), would not find her presence on the board a reason for celebration.

     

    But in my interview with David, he acknowledged with a smile that she certainly has the right to run for the post and if elected, the right to sit on the board.

  8. I think you may want to go back and re-read the settlement agreement. There was no prior agreement to fund her job at the BOC or the DA. Just was kind of ironic that her new job at the DA's Office got cut because of oveall budget cuts caused by Sheain's failure to pay off the bond service fees with an increased tax. Instead, he and his entire administration including Beverly Cochran tried to get a SNEAKY back door tax approved. When they got caught doing so, the pulled back and let the tax increase die on the vine and as a result had to service the bonds from the general county budget. Which left us broke.

    The BOC as a whole never voted anything concerning Beverly. Austin chose to do so on his own just to get it over with.

    Uh-ha.....in bold. Doing some backtracking now huh and adding a new accusation? :rolleyes:

If I heard it correctly it took the full commission to fire her and Austin made an agreement with her to transfer her to the DA's office and fund the job until her retirement which was due to happen in the near future. I would want to get the time in for my retirement too. I think anyone would. They cut her job even after the agreement was made to fund it so she went to an attorney who worked out a settlement and she left after being given said settlement. I did not see anything illegal about it. Did I misunderstand what was said?

    No, you saw just as I saw and she had a contract that was broken. Any person would sue if they had a contract and it was broken.

    This is not about Beverly at all.

     

    This is the intentional smear campaign against Beverly because you have not made any headway with your lawsuit against the county of the previous BOC administration. You, Whitey and Feelip have done this before with previous BOC elections, not to mention, the BOE elections.

     

    You are on this campaign due to the fact that Beverly was an employee of the previous administration who had NO powers whatsoever to affect any decisions made by the BOC or did she affect anything illegal or a party of any illegal decisions or activities.

     

    If this is true, and if she won an out of court settlement, which would be within her constitutional rights to pursue if she felt wronged and obviously she did, it was within her rights to do so. Since she must have been right, it appears she won her case. Furthermore, she won outside of court which means, the county might have lost if it went to court as agreements with her employment possibly was the issue regardless. That is how 1/2 the cases work by doing an out of court settlement and IS completely irrelevant.

     

    Surepip, you are pushing this personal vendetta way too far concerning Post 2, an area in which you do not even live in.

     

    You are not attacking anybody else or as fiercly in any of the other Post races including Post 2.

     

     

    I am disturbed that this site is allowing these attacks on this level based on a personal vendetta with the previous administration and Beverly being caught in the crossfire as a result.

     

    Call it what you will, Surepip, but the past rants in the last elections and now this, the proof is in the pudding.

     

    Your issue belong in the courts, not on here. Just because someone wants to serve the people of the county and in this case, Post 2 which is the post I live in, you come on here attacking her as if she is a party to any lawsuit you have with the county. Anyway you slice it, it is ethically wrong and I will speak up about it as I see fit.

     

    I am not her campaign spokeman and no, she will not come on here to play games with some people trashing her for no reason whatsoever and accusing her of anything you can drum up is not only beyond absurd, but is without merit.

     

    If she filed such a suit or threatened to do so concerning her employment, it is solely her private business, not anyone else's.

     

    YOUR beef is with Jerry, so stick with that and leave Beverly out of this as she has no bearing in your case.

     

    Yes, I am voting for her. However, what I said above has no bearing as such, just stating facts. And no, it is not blackmail. It does not matter whether a person is a government employee or not, they have constitutional rights to file if they feel wronged, period.

     

    Now, let's stick to what she will do for us and leave this petty trashing out of it. :good:

  11. Still say he has no record to stand on. If I were a temporary House member I would do the popular thing with the folks in the 19th and it would not be enough for any voter to base their July vote on. Not enough time in office to have a record, sorry if that does not jive with your view PT.

    But that would also pertain to any candidate who has or will run in a special election.

     

    I have seen his voting record along with his reasons for voting the way he did.

     

    You know I am supporting Paulette but that doesn't mean I cannot say that Daniel didn't do what he said he was going to do. Yes, he missed some important legislation but he does have a record, regardless.

  12. Newly elected and/orappointed politicians generally bring in their own staff.

     

    Those who were working for the previousadministration have no job security once the new officials take office. The“closer” a job was to any such official, the less security it has when thepolitician departs.

     

    That is a fact of life forall who work for elected and appointed officials from the city/county level tothe State to the Federal levels. It is SOP to be replaced.

     

    It seems Beverly Cochranthought her job was secure, forever, or at least until SHE chose to retire orleave. She had worked as Bill Carruth’s Administrative Assistant and JerryShearin kept her for 8 more years when he occupied the Chairman’s seat in 2001 through 2008.

     

    When David Austin took office, in January 2009 he chose to replaceBeverly Cochran. Instead of just laying her off, he made arrangements for herto take another job with the DA’s office, and from what I understand, at thesame pay level.

     

    So she went to work for Drew Lane at theDA’s Office upon leaving as the BOC Chairman’s assistant winter of 2009.

     

    When it became evident thebudget was going to require some MASSIVE cuts, because of the downturn in theeconomy, and the FACT the previous BOC administration in July/August of 2008chose not to increase the bond millage rate to service the bonds issued for thenew Courthouse Administrative Complex and the Green Space purchase.

     

    Instead of having anelection year tax increase, Jerry Shearin and the BOC chose to service thebonds for 2008 from the funds in the country surplus account after they gotcaught publicly trying to SNEAK through a quiet back door tax increase.

     

    So, when 2009 rolled in and David Austin took office, he was left with adepleted surplus account and had no choice but to increase the bond millagerates AND require virtually every county department to make severe and drastic budgetcuts as well.

     

    The DA’s Office Budgetcutting included eliminating Beverly Cochran’s new job, and she was laid offsummer of 2009.

     

    So she hired an attorney andthreatened to sue the county as a result of losing her job.

     

    What The Hell?!?!

     

    David Austin agreed to anout of court settlement with BeverlyCochran of $49,999.50 which was finalized and executed on September 1st,2009 “solelyto avoid the expense of potential litigation and in compromise of disputedclaims”.

     

    And it appears BeverlyCochran then got to draw unemployment from September 1st 2009 until she qualified to run for the Post 2commission seat in April, AND was paid her salary during the time her attorneyand the County negotiated her settlement when she was laid off until September 1st.

     

    Must be nice!

     

    Does this mean any and allother county workers who were laid off can sue the county and collect asettlement agreement ?

     

    How about the almost 300teachers getting laid off at the end of the school term?

     

    When your job is working foran elected politician there is no job guarantee or security of any sort whenthat politician gets defeated at the polls or retires. Life goes on. You getover it and hunt a new job.

     

    And now Beverly Cochranwants to be elected to the BOC as the Commissioner for Post 2 ?

     

    WHY?

    I have said it before:

     

    If you liked Jerry Shearinand his band of ROBBER BARON MEGA DEVELOPERS and how they have run the countyfor the past decade plus, then by all means support Beverly Cochran [and Jason Anavitarte ? As well?] and put Jerry’s voice and influenceback on the BOC.

     

    If you want to break the Good ‘Ol Boynetwork. once and for all then re-elect Tommie Graham and elect Todd Pownall to the BOC.

     

    That will leave Larry Ragsdale andwhoever replaces Kirby with 2 out of 5 votes to support the RBMDs and theGood ‘Ol Boys.

     

    Beverly got her pound of flesh, and Paulding Countyneeds to move on without the RBMDs continuing to pull the puppeteer strings.

  13. Best I can tell, Stout has one foot in and one foot out of Paulding and is sort of a one issue candidate. Seems focused mostly on the right to life issue. Also,is he still a banker? Heard he quit his job. What has Golden done for Paulding in the past? I know he is a developer and builder but does anyone know with PERSONAL knowledge,if he has been part of the "good ole boy network" that got us where we are here? I'm just curious. Also, Braddock owns a business? Is it related to building or banking? What is her business? Did she inherit it? We need someone who knows how to get jobs back here, who will not serve his or her own personal business interests. I'd like some answers from candidates on these questions.
