  1. The second amendment guarantees that the right to bear arms shall not be infringed, yet one may not carry a firearm into a courtroom. How is the enforcement of this rule “which is contradictory to the second amendment” any different to the no headwear in the courtroom rule? I do understand that state statute governs the possession of firearms while there is no statute governing the wearing of headgear in the courtrooms. But the end result is the same, someone’s rights wind up being infringed.

     

    Another example, some folks would like to prohibit the carrying of firearms in church, this is a clear violation of the second amendment “SHALL NOT BE INFRINGED”. But some think constitutional rights end when one enters onto private property, and the owner has domain over those who enter. Don’t like the rules? Don’t enter. Well the judge has domain over his court, don’t like the rules, don’t enter. Compelled to appear? Arrange for special accommodations if required prior to your court date. And by no means show you’re a$$ in the court building unless you are just looking for your 15 minutes of fame and a ride to jail.

     

    By not allowing her to enter the court with her headgear her rights, in my opinion were not violated, she had option to remove it or leave. If she had no option except to appear in court at that time THEN she may have an argument. But the government did not compel her to be there so court rules apply to her as any one else.

     

    Personally I think it is all a part of the Muslim extremists attempt to unravel the fabric of our society from within.

  2. Trust me on this, I am an IPTM and NHTSA certified instructor on the operation of LIDAR “laser” and radar.

     

     

    Laser is target specific and will not alert a detector in a vehicle that the laser is not aimed at. And depending on the distance may not even trigger an alert in the target vehicle.

     

     

    And with radar if you are a lone vehicle and it starts to chirp all that is telling you is that you have been checked and if you were speeding you may be in for an encounter with the police shortly. I have your speed locked before you can process the detector going off and start to react to its alert.

     

     

     

    And just for the record, I do not arbitrarily ask for consent to search. If I am asking for your consent to search I have already established probable cause to search and do not need consent but ones reaction to the request in this scenario is priceless.

    She has the right to practice her faith & whether she is devout or not, that is up to her God, not the court. It is her claim of religion, & no gov't has the right to tell her her she can't practice her faith, within limits, of course --- no human sacrifice, though we may make exception for Liverpool fans.

     

    Sinning in anger doesn't mean she isn't devout anymore than the pastor at Trinity Chapel isn't devout even though he was caught in sexual sin. Sin is a human condition between the person & God, not the person & the judge. Only crimes should come before the judge. Sins are left to a more righteous Decision Maker.

     

    The metal detector is a reasonable means of security for headgear as it is for clothing.

    That is a different situation, not the case here. If she is a defendant, it is reasonable to have her remove the veil, & there is a limit on liberty at that point.

     

    In this case, she was not a defendant & had every right as an American to be in the courthouse & practice her faith without fear of gov't interference of her free exercise.

     

     

     

     

     

     

    Aint nothing wrong with buds disagreeing. But the bottom line is people just cannot show there behinds in certain places rather it be a legitimate complaint or someone just trying to cause a stink about something. I do not know all of the facts on this case but I would venture to say that she went to jail for causing a ruckus, you just don’t do that in certain places (courtrooms, airports”. If she felt her rights were being violated she should have left the building and filed a lawsuit. And yes, I admit the fact that the explicative left her mouth dose not make her any less devout than any one else.

     

    It is the same thing with us and traffic stops, every now and then you get the one who wants to argue on the side of the road about “you are violating my rights”. If the person believes their rights are being violated there are appropriate avenues to take, showing your behind with me on the side of the road is almost going to guarantee a ride to jail.

     

    I am aware that she was not a defendant in this case but I think the argument is the same. Anyone entering the courtroom is subject to the courts rules. If an exception is allowed for one it must be made for all, if they are sitting at the defense table or in the gallery.

    Please explain how the headscarf poses a security threat after a metal detector check point that a regular blouse doesn't pose? People wear clothes into the courtroom & could hide things under there --- but that is why there is a metal detector.

  6. How hard is it to respect someone else's religious beliefs.

    I mean really, it was an ego trip by the judge.

    She is a devout Muslim, her scarf does not hurt anyone.

    Perhaps she offends others by just being of a religion besides Christian.

     

    This type of intolerance in our courtrooms should make everyone pause and think.

     

    This judge may be intolerant of folks with tattoos, different skin color, nationalities.

     

    We should not be applauding a judge the openly shows intolerance in his courtroom.

     

    Before anyone brings up rules, this says a lot about the character of a very powerful person.

     

    We don't have Jewish, Christian, Muslim, Buddhist courts in this country we have courts of law, supposedly fair and just to all.

     

     

    We should applaud the judge for taking a stand against those people who are using the “freedom of religion” clause to undermine or circumvent any security infrastructure in our country. It is obvious she is not “devout” or the expletive would have not come out of her mouth. It fails to amaze me at the folks who insist on showing their backsides in such security sensitive areas like airports and courtrooms and then cry foul when action is taken against them.

  7. The Fulton County sheriff's office was warned that Nichols "might do something" during his rape trial, but they ignored the warnings. Now 4 people are dead. The families of the victims should be angry. Do you think they trust the po-po? I sure as heck wouldn't!

     

     

    When the defense and the courts will not allow the defendant to be properly restrained lest it may make him look “guilty”to the jury what else are they supposed to do. I do agree that the transfer and handling of prisoners should be different but it is the courts that have the final say in how a defendant is restrained or not restrained at all while being introduced into the courtroom. Your statement just took all of the blame for these murders from whom it lays “Nichols” and placed it on some one else. Your post is an insult to those who died that day and to all of those who have made the supreme sacrifice while protecting others. It is an insult to me and 700 thousand +- other officers, who stand ready 24/7 to place ourselves in harms way to protect people like you..

    49 cfr §390.21 Marking of CMVs.

     

     

    (a ) General. Every self-propelled CMV, as defined in §390.5, subject to subchapter B of this chapter must be marked as specified in paragraphs (b ), ©, and (d./) of this section.

     

     

     

    (b ) Nature of marking. The marking must display the following information:

     

     

     

    (B.)(1) The legal name or a single trade name of the motor carrier operating the self-propelled CMV, as listed on the motor carrier identification report (Form MCS–150) and submitted in accordance with §390.19.

     

     

     

    (B)(2) The motor carrier identification number issued by the FMCSA, preceded by the letters "USDOT".

     

     

     

    (B.)(3) If the name of any person other than the operating carrier appears on the CMV, the name of the operating carrier must be followed by the information required by paragraphs (B)(1), and (2) of this section, and be preceded by the words "operated by."

     

     

     

    (B.)(4) Other identifying information may be displayed on the vehicle if it is not inconsistent with the information required by this paragraph.

     

     

     

    (B.)(5) Each motor carrier shall meet the following requirements pertaining to its operation:

     

     

     

    (B.)(5)(i) All CMVs that are part of a motor carrier's existing fleet on July 3, 2000, and which are marked with an ICCMC number must come into compliance with paragraph (B.)(2) of this section by July 3, 2002.

     

     

     

    (B.)(5)(ii) All CMVs that are part of a motor carrier's existing fleet on July 3, 2000, and which are not marked with the legal name or a single trade name on both sides of their CMVs, as shown on the Motor Carrier Identification Report, Form MCS–150, must come into compliance with paragraph (B)(1) of this section by July 5, 2005.

     

     

     

    (B.)(5)(iii) All CMVs added to a motor carrier's fleet on or after July 3, 2000, must meet the requirements of this section before being put into service and operating on public ways.

     

     

     

    Size, shape, location, and color of marking. The marking must—

     

     

     

    (1) Appear on both sides of the self-propelled CMV;

     

     

     

    (2) Be in letters that contrast sharply in color with the background on which the letters are placed;

     

     

     

    (3) Be readily legible, during daylight hours, from a distance of 50 feet (15.24 meters) while the CMV is stationary; and

     

     

     

    (4) Be kept and maintained in a manner that retains the legibility required by paragraph ©(3) of this section.

     

     

     

    (d) Construction and durability. The marking may be painted on the CMV or may consist of a removable device, if that device meets the identification and legibility requirements of paragraph © of this section, and such marking must be maintained as required by paragraph ©(4) of this section.

     

     

     

    (e) Rented CMVs. A motor carrier operating a self-propelled CMV under a rental agreement having a term not in excess of 30 calendar days meets the requirements of this section if:

     

     

     

    (e)(1) The CMV is marked in accordance with the provisions of paragraphs (B) through (d) of this section; or

     

     

     

    (e)(2) The CMV is marked as set forth in paragraph (e)(2)(i) through (iv) of this section:

     

     

     

    (e)(2)(i) The legal name or a single trade name of the lessor is displayed in accordance with paragraphs © and (d) of this section.

     

     

     

    (e)(2)(ii) The lessor's identification number preceded by the letters "USDOT" is displayed in accordance with paragraphs © and (d) of this section; and

     

     

     

    (e)(2)(iii) The rental agreement entered into by the lessor and the renting motor carrier conspicuously contains the following information:

     

     

     

    (e)(2)(iii)(A) The name and complete physical address of the principal place of business of the renting motor carrier;

     

     

     

    (e)(2)(iii)(B) The identification number issued the renting motor carrier by the FMCSA, preceded by the letters "USDOT," if the motor carrier has been issued such a number. In lieu of the identification number required in this paragraph, the following may be shown in the rental agreement:

     

     

     

    (1) Information which indicates whether the motor carrier is engaged in "interstate" or "intrastate" commerce; and

     

     

     

    (2) Information which indicates whether the renting motor carrier is transporting hazardous materials in the rented CMV;

     

     

     

    (e)(2)(iii)© The sentence: "This lessor cooperates with all Federal, State, and local law enforcement officials nationwide to provide the identity of customers who operate this rental CMV'; and

     

     

     

    (e)(2)(iv) The rental agreement entered into by the lessor and the renting motor carrier is carried on the rental CMV during the full term of the rental agreement. See the leasing regulations at 49 CFR 376 for information that should be included in all leasing documents.

     

     

     

    (f) Driveaway services. In driveaway services, a removable device may be affixed on both sides or at the rear of a single driven vehicle. In a combination driveaway operation, the device may be affixed on both sides of any one unit or at the rear of the last unit. The removable device must display the legal name or a single trade name of the motor carrier and the motor carrier's USDOT number.

  9. We do have a DOT# on the truck and the truck is for a small business. The truck is a one ton 3500 Chevrolet box truck. The PCSO said we must put the company name on the truck and the driver has to have a medical card. We're a very small company and are just trying to make it and this officer just keeps pulling us over. He followed one of my workers into Home Depot the other morning and wrote him up for no seatbelt.

  10. The Pension Guaranty Trust. Here's the link.

     

    It is similar to the FDIC. This is not funding anyone's retirement, but upholding the obligation the pension programs made before 401k plans became the main plan for retirement. Remember, 401k plans have only been around since the very late 70s. Before then, pensions were the only retirement for employees & thus the gov't set up a similar program to the FDIC to make sure folks didn't retire & the promise of the pension left when the company went under.

     

    The PBGC did the same for the manufacturing companies that went under in the 70s & 8 0s, particularly the steel mills. Been around for a while.

     

     

    Wow. This subject is not my forte, but I just do not understand how the burden of funding these pensions can fall back on the taxpayers if the company failed to uphold its obligation regardless of the circumstances.

     

    But the taxpayers of this country have been raped by the government via taxes ever since the “new deal” bunch and it just keeps getting worse.

     

     

     

    Even though taxes are not supporting this program the bailout in a round about way is in my opinion indirectly supporting it by allowing the employers to put funding into other projects instead of tending to their standing obligations.

  11. If the companies file for bankruptcy and shed their pension obligations the govt agency that gaurentees them has to pick up the tab. We the tax payers and any company that still offer pensions will have to pick up the tab.

    He not only should not have did what he did, but he should have provided escort to the hospital.

     

    If not fired, this trooper should have been severely reprimanded.

     

     

    When you terminate or reprimand someone there are elements of misconduct that must be substantiated. This means violation of state or federal law or violation of written departmental policy. I know of NO agency that has anything in their policy about officers authorizing persons to violate state law or guidelines spelling out when certain laws are not to be enforced.

     

    WT, you are the department head for the agency this officer in the story works for, cite your legal/administrative argument for censure, disciplinary action or termination of this officer.

     

  13. The bottom line is, there is no legally justifiable reason or excuse to violate state law or statute. If you choose to violate the law for any reason, you run the risk of having enforcement action taken against you. A lot of you folks want you’re sense of morality injected into the enforcement of the law. It doesn’t work that way, we have discretion in certain matters. Not all of us have the same sense of discretion. What one officer would give a pass on another one may not. Did this officer act appropriately? Absolutely, he violated no laws in the course of his actions. Does it mean that it was the morally right thing to do? That will depend on who you ask.

     

    The only people that folks with legitimate excuses (having a baby) have to thank for the lack of compassion from enforcement personnel is all of the folks who willingly violate the law and then make up false excuses for their actions, after a while you just become desensitized to them.

     

  14. You're right, my bad. I just went back and began adding the description after the names when I realized that probably half of the folks on here wouldn't know who the heck I was talking about, particularly the drivers, and he was bunched in the "astronaut" group in my mind at the time.

     

    I met him at Edwards when my father was out there in Flight Test many years ago, and he used to come over for dinner. I met Wally Schirra a few years later at Patrick AFB, and I remember he gave me the keys to check out his new Corvette while he and Dad talked "business" at the O-Club. Big thrill for a kid who was into the space program and cars in the early 60's.

     

     

     

    WOW what a privilege. I know chuck through Col. John Howe (USAF) Ret. A long time friend and coworker of chucks.

    I dated John’s daughter for a while and Chuck was a frequent visitor at their house. So I have been priviledged to spend more than a few minutes in the company of this true American icon. ( I say icon because he will tell you quickfast that he isn’t a hero, he was just doing his job) although in my book he is a prime example of a true American hero.

    Rick Schroder (silver spoons kid) met him water skiing at Castaic Lake in California. Our boat crapped out and Rick towed us back in and was nice enough to let us ski with him and his family. We didn’t even know who he was until we were getting ready to leave. He told us it was pretty nice to be able to hang out with people who did not recognize him from TV. I was invited to his ranch in Colorado but never found the time to go.

    The reply is going to be something about a mortgage I'm sure. (Hah! I don't plan on having an infinite mortgage so I understand these things!)

     

     

    I am debt free. I have not owed or paid on a revolving or any other credit account for years. There is nothing on my credit report, good or bad, this results in a low FICO score. Auto insurance companies use this score to determine your “risk” and determine your auto premium. I own a pickup, it is a 03 dodge Hemi short bed regular cab with 35,000 miles. My driving record is spotless. Full coverage insurance cost me over 2,000 a year. When the truck turns 50 k miles I will drop down to liability only.

    I am penalized because I am financially responsible and do not purchase things on credit.Not to say that those who use credit are necessarily financially irresponsible. But the law allows the insurance companies to determine that I am a higher risk because of a low FICO score. This is ridiculous.

    As I have said before, there are exceptions to everything. Foreigners are like any other group of people, there are some bad mixed in with the good. I've been worked many different careers in my life and have met and dealt with many different people. And wcso84, I had a career as an LEO for a major metro department, so I have seen what you talk about. I have seen just as many "local" bad business owners as anyone else. Didn't I say that most of them could pinch a penny and give back change? Sounds like good business sense to me!

    Acquiring an asset, milking it dry and not investing in it to maintain it to reasonable standards of service is not good business.

  20. OK. A friend of mine from South Dakota flew down yesterday. We went for breakfast this morning before he had to leave. We went to a local momnpop restaurant. We both ordered the regular breakfast that includes pancakes. Well he puts butter and syrup on his pancakes and then takes a bite. He promptly spits it back out, and says something is wrong with them. I try mine and they taste fine. So I try his and they are fine. So he try’s a bite without syrup on it and then try’s the syrup and tells me the syrup is bad. I told him that there was nothing wrong with the syrup. He says it taste “sharp”; WTH?

    Then I realize, we are in the south, and most home style eating joints down here have cane syrup instead of, whatever that other stuff is “Mrs. Butterworth stuff”. Maple I guess.

    I grew up eating cane syrup and do not care for any other kind. But it just got me to thinking, what is your preference.
