Private citizens can not be issued a search warrant that even seems "innocent". Illegal activity has to be identified that amounts to probable cause and presented to either a judge of the State or Federal Courts. Any and all other eavesdropping is a crime. You can't "see" it! Of course I call Comcase at 4:21 PM and their "call center" is closed. The last time I called about the phone being out they actually asked if I was calling from the phone I was reporting trouble on. I said, "Are you sure you thought that question through before you asked"?

Okay....I can take a joke with the best of them, but I'm real curious about why my Comcast home phone plays elevator music (and pretty bad elevator music at that) when we try to make outgoing calls. If I wanted to hear bad music, I'd just stick my head in a bucket and sing. Anyone else having this problemo?

Who knows how the judge came to that decision, but I wouldn't suspect law enforcement bias considering the victim was the wife of an LEO and that deputies victim statement was heard by the court. Judges make their decision on many factors, the main one being a person's criminal history. If I was the husband, I wouldn't agree either. There have been quite a number of sentences I haven't agreed with and a majority of them didn't even involve LEO's.
