Not in any state that I've ever heard of . You are allowed to call the Extension office and ask them what to do and in some situations they will come to help. Killing any songbird is completely illegal. It is legal to kill any bird that has a 'season' or is considered a pest (like starlings) It IS illegal to possess any item belonging to any wild animal/bird-or at least it was when I worked at the nature center in Roswell. Do you have a copy of the law stating what you say? The laws have perhaps changed? I could be wrong!

**Edited to add---It is also ILLEGAL to collect wild animals/reptiles/bird from the wild and make it a pet-this would include turtles, most lizards, mammals and songbirds**
Ok, well you are wrong. Killing ANY animal that is causing damage to your property is PERFECTLY LEGAL.
It doesn't matter if it's a song bird or a wolf.
This is directly from the FAQ on the Georgia Department of Natural Resouces website"
What acts are prohibited for protected animals? It is unlawful to harass, capture, kill, or otherwise directly cause the death of any protected animal species, except as specifically authorized by law or regulation adopted by the Board of Natural Resources. Protected animal species or parts of protected animal species cannot be sold, purchased, or possessed unless authorized by a permit issued from the Department of Natural Resources. The destruction of the habitat of any protected animal species on public lands is prohibited.
How does listing affect the rights of landowners?
Georgia law specifically states that rules and regulations related to the protection of state protected species shall not affect rights in private property. Prohibitions (see FAQ below) are limited to the capture, killing, or selling of protected species and the protection of the habitat of these species on public lands.
See that? SHALL NOT AFFECT RIGHTS IN PRIVATE PROPERTY
It's illegal to hunt song birds and kill for pleasure, but it is NOT illegal to shoot one if it's causing property
damage.
They better be on your property and be causing damage. Otherwise, you are in violation of the law.
Now, when I say property damage, I don't mean building a nest that makes some dirt.
I mean full out, damage to property, such as a woodpecker causes to some structures.
It's VERY rare that a song bird will ever cause any damage, so the point is really moot.
However, woodpeckers or other birds that cause damage are legal to dispose of if causing damage.
It is NOT illegal to possess any item belonging to any wild animal and if you learned that at the nature center, someone over there needs to learn their facts.
Do you know how many hunters have deer heads hanging on their walls?
Do you know how many fisherman have fish hanging on their walls?
Ever seen a stuffed bear in the Bass Pro Shops?
The "it's illegal to possess an item from an animal" is for PROTECTED wildlife, not ALL wildlife.
ALL song birds are NOT protected.
I hope you don't think I'm promoting the killing of any animal, song bird or otherwise.
But you should get your facts straight when concerning property damage.
I have about 8 feeders around my house and I love watching the birds...
I have about 15 hummingbirds on my front porch at any given time...
I have taken many of cats off to the burial grounds because they stalk and attack/kill song birds.

Is it illegal too shoot a bird if its in your own yard?? what about if you shoot it w/ a bb gun?? does that count??
Migratory birds are generally protected.
If a bird is doing/causing damage to your property, you are supposed to shoo it away.
If it fails to leave or returns to continue causing damage, you are allowed to shoot it.
Woodpeckers included.
Crows are considered "Scavenger" birds, just like Vultures and Buzzards and are protected.
Unless they are causing damage, it's illegal to shoot one.
It is NOT illegal to shoot birds simply because they are native to the US.
It's NOT illegal to have feathers of birds or a nest by anyone, UNLESS it's a "bird of prey" or a protected
species.
It is true that Native Americans are except from this as they see feathers of the Eagle as spiritual.
Is it illegal too shoot a bird?

What crappy law are you talking about?
Do you feel that we don't have the right to protect our property?
Do you not think that if a wood pecker is causing damage to my property and I try on
several occassions to get it to go away, that I don't have the right to shoot it?
