  2. For any business owners in the know please confirm :

It is my understanding of Labor law that all businesses, other than servers in restaraunts or others who work for tips, that the business must pay at least the federal minimum wage. Is this correct ?

I ask because a business in Paulding Co, is advertising on craigslist and I believe they have also advertised for help on Paulding.com. The business called my friend for an interview. When she went for the interview she was informed that she was qualified and they would hire her..................at $4.00 per hour ! When she interjected that the minimum wage had just been raised to I believe $6.85 she was advised by the business owner that she would be " in training" for the first 10 months and they would only pay $4.00 per hour and that it was legal ! Well my friend promptly walked out of the interview and informed the owner that she was reporting him to Department of Labor.

Am I correct that this is Illegal !

The current federal minimum wage is $6.55 hr. However, a "special" minimum wage of $4.25 per hour applies to certain employees under the age of 20 during their first 90 consecutive calendar days of employment. After the 90-day period, employers are required to pay the full minimum wage. There are other programs that allow for payment below the federal minimum wage for "full-time students" and "student learners."

    Full-Time Student Program

This program is for full-time students employed in retail or service stores, agriculture, or colleges and universities. The employer that hires students can obtain a certificate from the Department of Labor which allows the student to be paid not less than 85% of the minimum wage. The certificate also limits the hours that the student may work to 8 hours in a day and no more than 20 hours a week when school is in session and 40 hours when school is out, and requires the employer to follow all child labor laws. Once students graduate or leave school for good, they must be paid at least the federal minimum wage.

    Student-Learner Program

This program is for high school students at least 16 years old who are enrolled in vocational education (shop courses). The employer that hires the student can obtain a certificate from the Department of Labor which allows the student to be paid not less than 75% of the minimum wage, for as long as the student is enrolled in the vocational education program.
