    Disorderly Conduct:

     

     

     

    a) A person commits the offense of disorderly conduct when such person commits any of the following:

     

    (1) Acts in a violent or tumultuous manner toward another person whereby such person is placed in reasonable fear of the safety of such person´s life, limb, or health;

     

    (2) Acts in a violent or tumultuous manner toward another person whereby the property of such person is placed in danger of being damaged or destroyed;

     

    (3) Without provocation, uses to or of another person in such other person´s presence, opprobrious or abusive words which by their very utterance tend to incite to an immediate breach of the peace, that is to say, words which as a matter of common knowledge and under ordinary circumstances will, when used to or of another person in such other person´s presence, naturally tend to provoke violent resentment, that is, words commonly called 'fighting words'; or

     

    (4) Without provocation, uses obscene and vulgar or profane language in the presence of or by telephone to a person under the age of 14 years which threatens an immediate breach of the peace.

     

    (B) Any person who commits the offense of disorderly conduct shall be guilty of a misdemeanor.

     

    © This Code section shall not be deemed or construed to affect or limit the powers of counties or municipal corporations to adopt ordinances or resolutions prohibiting disorderly conduct within their respective limits.

    NOW. dont get me wrong, I would NOT, make a juvy case under this statute for the above incident alone.

  3. If you look at the forcasted trail of the oil--it is going to the Atlantic as well. I also have a vacation planned in PCB for July and Labor Day--We will just hang out in the pool if we have to. Hopefully the pool will be less crowded--since everybody is changing their vacation. I am going down to hang out with a bunch of friends that live down there--but I am taking family on the July trip. Labor day is all ME!!!

  4. This is funny. They are building this right behind our office and most of the workers use our parking lot as a cut thru. I will say that at least 80-90% are of mexican decent and most speak no english. We laugh because at least 3 or 4 days a week, they have a mexican roach coach back there at lunch and they come running off the job to get in line!!!

     

     

    Like these folks are gonna know what a roach coach is. :rolleyes:

  5. Actually, you left out one more situation - the possibility that the Police Chief was offered a job with another police force and asked the Lt. to join him.

     

    I don't know what happened, but I feel pretty confident that once the facts are out there, Pubby will enlighten us.

    I have seen this situation play out on more than one occasion. As chief deputy of a department in Kansas, in the first part of this decade, I was offered a position as chief of police with a department in another part of the state. Had the terms been right and I accepted the position my lieutenant would have left the sheriff’s department also to take the position as my assistant chief. SO, I would have put in my resignation along with a lieutenant in the same department, at the same time. I do not owe it to the public to disclose any personal decisions I make, if you want to know, make an open records request.

     

    With that said, I do not know anything about the hierarchy

    of Hiram PD, or any indiscretions, past or present of those in question here.

     

    All I am saying is STOP THE RUMOR MILL.

     

    If you have facts, fine post them.

    If you want the facts, do some research and find them.

    Just stop the unfounded bashing.

    That is the point, we all know AFTER the fact that she was just a unarmed foul old biddy, but the officer did not have the luxury of knowing this during his initial encounter, had she been more than a foul old biddy the officer could have very easily lost his life had he not kept control of the situation and subject

    She was trying to go back to her vehicle, the officer did not let that happen.

     

    Unfortunately Deputy Dinkheller let his unarmed subject return to the vehicle, Deputy Dinkheller is no longer with us.

     

     

    If deputy Dinkheller had used force in keeping this guy from returning to his vehicle and to effect the arrest, would folks be crying foul on this dirtbags behalf?

     

    "Well, the guy was just being an a$$ and mouthing off ,that is all he was doing, is that reason to use force?"

    Yes because belligerence and noncompliance escalated into murder.

    318.14 Noncriminal traffic infractions; exception; procedures.--

     

    (1) Except as provided in ss. 318.17 and 320.07(3)©, any person cited for a violation of chapter 316, s. 320.0605, s. 320.07(3)(a) or (B), s. 322.065, s. 322.15(1), s. 322.16(2) or (3), s. 322.161(5), s. 322.19, or s. 1006.66(3) is charged with a noncriminal infraction and must be cited for such an infraction and cited to appear before an official. If another person dies as a result of the noncriminal infraction, the person cited may be required to perform 120 community service hours under s. 316.027(4), in addition to any other penalties.

     

    (2) Except as provided in s. 316.1001(2), any person cited for an infraction under this section must sign and accept a citation indicating a promise to appear. The officer may indicate on the traffic citation the time and location of the scheduled hearing and must indicate the applicable civil penalty established in s. 318.18.

     

    (3) Any person who willfully refuses to accept and sign a summons is guilty of a misdemeanor of the second degree.
