I don't really see anything shocking if you look at it from the legal side instead of emotionally. Fault was not clear cut and both sides had contradicting accounts including one that favored Progressive that was inside the deceased vehicle.

An insurance company is not there to be your friend and there is nothing improper about them being an adversary of their client in court if there is a question of fault that would make them liable. They system worked as it should and a jury decided after viewing all the evidence.

Why is this news? This is how insurance works. If it is a fault loss, the company pays. If not, they don't. The company, the insured, the other insured/company, and the legal system are adversaries. That is called the free market.
People. Planet. Profits. In that order.

I can't see good faith in a person's own insurance company refusing to pay up, when the guilty party, insurance has already paid its part. There should have been punitive damages added to the $75,000 owed, for neglect of good faith in the case. Posted Image

Nothing would surprise me about anything Progressive does. Their CEO is a noted left-wing nut in the same mold as George Soros. He is a huge donor to ACLU and to Obama's campaigns.

Plus, that "Flo" in their ads is the most obnoxious character on TV. :wacko:
Calling an illegal alien an "undocumented worker" is like calling a drug dealer an "unlicensed pharmacist".

I would think I would not have to worry about sueing my own insurance company in such an odious open and shut case....
The person in the car was shown to have memory issues and is questionable.
I think it is totally wrong on progressives part. I will not even consider them as a insurance from now on.

ALL insurance companies are like this...all of them! State Farm being the worst.

No kidding. I had State Farm and was in an accident with another State Farm insured, it was her fault when she turned left in front of me at an intersection and I broadsided her in the front quarter panel and passenger door. It took almost 2 weeks for an adjuster to even call me back, much less get a rental or to begin to pay for medical bills because I had been hurt. The settlement process was even worse. After they finally settled, I was cancelled because of my 'driving record'. First of all, we had had ins with the same agent for almost 20 years and had never had a claim. I had gotten one speeding ticket too long ago to remember and Hubby was clean all the way around. HATE State Farm.

I can't say much right now as I am going through a lawsuit with State Farm right now. It has been hell and I have been shocked at how State Farm operates!!

From a different perspective, I deal with auto insurance companies every day in auto glass claims.

The absolute worst to work with is Allstate. State Farm, OTH, is the absolute best when it comes to smoothly handling a claim and getting the insured taken care of.

We do a good bit of glass business at body shops. Those shops tell me they like working with State Farm, Geico, Nationwide, and USAA. Now, all that is on the property damage side of a claim. Liability issues are a different thing, and I can't speak to those issues.
