Need Lawyer Rental Contract

Hello All,

I need a lawyer to help me with a lease that was broken by a tenant. She did not give notice, did not pay rent, and left my property damaged and yard a total mess.
I now longer live in GA so would like to talk to one over the phone.

go to the court house (or have someone do it for you) File papers in magistrate court-list all unpaid rents, months left on the lease, amount of damages, clean up, etc ( take pic and document damages) cost to file is $101.-list that too-they will tell you the court date. If you can't be there, then you will need a lawyer or representative-I think power of attorney will do for them, but check that. If a property mgnt company can do it, i don't see why another rep can't. the problem is that then it is up to you to collect-you may have to file again for a garnishment-called a fi fa ( or something much longer in Latin)-more money, but then it will be collected directly from their salary-as long as they are not self employed. I've done it several times as a landlord-very simple but time consuming-good luck!

If Jeanne can't help you, the best real estate attorney I know (she really is the best) is Amee Davis. She gets every deal I can send. There isn't a better real estate attorney anywhere.

Good luck getting anything out of them...If they didn't have the $ to pay you then, chances are they have nothing to go after either. Fine with magistrate and I say cut your losses. Good luck!

But a judgement lien and a negative hit on the credit report might help another landlord from making the same mistake. I say go after them. The only way to help combat a crime is to enforce the agreement. And what that tenant has allegedly done is a crime.

Thanks I have spoken with a lawyer. She can afford it and she bought a new house 1 mile from the house she was renting from us. But forgot to tell us that part I would have understood bettering herself and family. But do not lie to me and screw me with rent.
Found a new renter that moves at the end of the month :)

How do you report this on ones credit report if you are a "private landlord"?? Is this worded right?? I was told that a private landlord can't run a credit report on someone, it could be done by a rental management/real estate type business but not an individual person, is this true?????

Once a lawsuit is filed, it will show up on your credit report usually within a month. Then when the Judgement is entered, it also shows up. All of the credit reporting agencies pull that info at least monthly. And there are companies that pull the info weekly and attorneys and such buy it for advertising.

Ohhhh, OK, Thank You. I had to file a garnishment on one of my tenants and it was my first time, I knew nothing about "how" to file and I lost quite a bit of money because of me NOT knowing how to do things. The court house employees WILL NOT offer any help or information AT ALL on how to do things. I was never told that the garnishment would expire in 6 months, I was never told I had to have the person's social security #......... anyway, I knew where the man worked at and luckily, he kept his job. The balance of what he owed after the 6 months was up really, was not worth all of the hassle to go and reapply for another garnishment in Fulton Co. But, next time I will know!!!!!!!!!!!

I see your question was answered. But to elaborate on one point. I recommend the use of a private company, I have a specific one I use, to all of my landlord clients. The tenant pays an application fee to the landlord which the landlord uses to have this private company pull a credit report as well as run a criminal history (felony only as that's all the public is allowed to see) and search the prospective tenant's name against the sex offender registry. If all reported is satisfactory to the landlord, a tenant is usually approved for a rental. If you would like the name of the company I recommend, email me.
